OCA Circular No. 201-2022: A Big Win!

To all BJMP and Provincial Jail wardens, Parole and Probation Officers, jail volunteers, PAO lawyers, and others concerned: Persons Deprived of Liberty (PDLs) who have completed their sentences should be automatically released as long as there are no other pending cases. The issuance of a RELEASE ORDER is not necessary…For probation applicants who had served their sentences but whose application had not yet been processed due to the delay in procuring official documents (such as NBI clearance), they need NOT file a motion to withdraw application for probation. Huwag nang patagalin ang paglaya.

Waiting for the release order, even when the accused served his or her sentence may take days, weeks, months and even years, thus prolonging their agony! We have long advocated for this!!! Thanks to the Supreme Court for heeding our recommendations! I estimate that thousands of PDLs will benefit from this and the government will save millions of pesos on food savings alone! It will also de-congest the jail and improve the administration of justice!!!! Big win! Please share and disseminate!!!
