1. Simplify the procedures
Create a one-stop shop. Many families get confused with the numerous offices they need to visit.
2. Minimize the number of requirements
Avoid unnecessary documentation. The current system imposes self-inflicted wounds on Persons Deprived of Liberty (PDLs), as many of the documents required are not even used once produced. These are merely for compliance, forcing PDLs to rely on bail bondsmen.
3. Conduct an information drive
Clearly explain the bail process, step by step.
4. Reduce the administrative cost of bail
Apart from the bail amount, PDLs incur additional expenses, which courts often maximize as a source of income. ( conflict of interest)
5. Lower the amount of bail
Strictly enforce the indigency rule, setting a maximum bail amount of PHP 10,000, which even then is often unaffordable.
6. Release on personal recognizance after six months
If a PDL has been detained for more than six months, they should be released on personal recognizance and attend hearings from outside the detention facility.
